1. Terms and definitions
- Provider — ITERRA KIDS TECH S.R.L., providing educational services under the iTerra Kids Academy brand.
- Client — an adult individual with full legal capacity, a parent or other legal guardian of the Student, who has accepted this offer.
- Student — the minor child in whose interest the Client enters into the agreement.
- Services — educational classes under the programmes published on iterrakidsacademy.eu.
- Site — the website iterrakidsacademy.eu with all its pages.
- Offer — this document as published on the Site.
- Acceptance — the full and unconditional acceptance by the Client of the terms of the Offer.
- Trial lesson — the first free introductory lesson.
2. Subject of the agreement
The Provider undertakes to provide the Client with educational services teaching the Student information technology under the chosen programme, and the Client undertakes to accept and pay for those services.
The list of programmes, age groups, format of study (online or offline), duration, number of lessons and price are published on the courses page and on the page of each programme. The information on the Site forms an integral part of this agreement.
Services are provided in a group format according to the schedule agreed on enrolment. Classes take place at the Provider's branches, listed on the branches page, or remotely by video link.
The Provider does not issue state-recognised educational certificates. On completing a programme the Student receives an academy certificate. Preparation for the international Certiport exams does not guarantee passing the exam: the exam itself is held by a third-party testing centre and is paid for separately.
3. How the agreement is concluded
The agreement is concluded as follows:
- the Client submits a request on the Site, by phone or at a branch;
- the Provider contacts the Client and agrees the programme, the group and the schedule;
- the Provider informs the Client of the total price, the payment procedure and the start date;
- the Client confirms agreement with the terms and pays for the services.
Acceptance of the Offer consists of payment for the services by the Client or the signing of a separate agreement at a branch. From the moment of acceptance the agreement is considered concluded on the terms of this Offer and has the force of a written agreement.
Before payment the Client may review and correct the details of the programme, group, schedule, format and total price. After payment the Provider sends the Client, without undue delay, a confirmation setting out the services paid for and their price.
Booking a trial lesson through the form on the Site is free of charge and does not constitute acceptance of the Offer. It creates no payment obligation and does not oblige the Client to continue with the classes.
4. Price of services and payment
Programme prices are shown on the Site in euro (EUR) and include all applicable taxes. The final amount and the payment currency are communicated to the Client before payment. For online payments from Romania the card is debited in lei (RON) and the exact RON amount is shown before the payment is confirmed.
The total price is communicated to the Client before payment and includes all mandatory charges. Additional paid services (individual lessons, participation in camps, sitting the Certiport exam, teaching materials beyond those included in the programme) are paid for separately and are never added to an order without the Client's explicit choice.
Payment is made online by card, by bank transfer to the Provider's account or at a branch.
Online card payment is processed securely by Banca Transilvania through BT iPay. Visa and Mastercard are accepted and authentication is performed via 3D Secure. ITERRA KIDS TECH S.R.L. does not collect or store card details.
The payment obligation is considered fulfilled once the bank confirms the transaction or, for bank transfers, once the funds reach the Provider's account.
Payment is made in advance for a study module or a calendar month unless the parties have agreed otherwise. The Provider may change the price of services; the new price does not apply to a period of study already paid for.
5. How services are provided
Services are provided according to the group's schedule. The start date and the schedule are communicated to the Client before classes begin.
- Missing a lesson on the Client's initiative is not grounds for recalculating the price unless the Client notified the Provider at least 24 hours before the lesson.
- If notice is given in time, the missed lesson is rescheduled or made up at a time agreed by the parties within the current study module.
- A lesson cancelled on the Provider's initiative is rescheduled to another date or its price is refunded to the Client, at the Client's choice.
- The Provider may replace the teacher while keeping the programme and level of instruction.
- The Provider may merge or dissolve a group if there are too few students, offering the Client a transfer to another group or a refund for lessons not provided.
6. Rights and obligations of the Provider
The Provider undertakes:
- to provide the services in the scope and within the timeframes stated in the programme description;
- to provide qualified teachers and the necessary teaching materials;
- to ensure safe conditions for classes at the branch;
- to inform the Client of schedule changes in advance;
- to process personal data in accordance with the Privacy policy.
The Provider may:
- refuse to provide services if the Student breaches the rules of conduct in a way that endangers other students or the teacher, having notified the Client in advance;
- suspend the provision of services if payment is more than 7 calendar days overdue;
- change the composition and content of programmes without reducing the stated learning outcome.
7. Rights and obligations of the Client
The Client undertakes:
- to provide accurate information about themselves and the Student;
- to pay for the services on time;
- to ensure the Student attends classes according to the schedule;
- for the online format, to provide a working device and internet access;
- to inform the Provider of any health conditions of the Student that affect participation in classes;
- to compensate direct damage caused intentionally by the Student to the Provider's property.
The Client may:
- receive information about the progress of the classes and the Student's results;
- transfer the Student to another group where places are available;
- withdraw from the agreement in accordance with sections 8 and 9;
- submit complaints in accordance with section 14.
8. Right of withdrawal
A Client acting as a consumer may withdraw from an agreement concluded at a distance within 14 calendar days without giving reasons. The period runs from the day the agreement is concluded.
To withdraw it is enough to send an unambiguous statement to iterraacademy@gmail.com. The Provider confirms receipt of the statement.
If, at the Client's express request, the provision of services began before the 14 days expired, on withdrawal the Client pays for the part of the services actually provided up to the moment of withdrawal, in proportion to the lessons held. The right of withdrawal ends once the services have been fully provided, where provision began with the Client's express prior consent.
Regardless of the 14-day period, the Client may at any time stop further classes, paying for the services actually provided.
9. Refunds
The detailed cancellation terms and how the refunded amount is calculated are set out in the Cancellation and refund policy, which forms part of this agreement.
On withdrawal from the agreement the Provider refunds the Client the price of services not provided within 14 calendar days of receiving the statement.
- The refund is made using the same means of payment unless the parties have agreed otherwise.
- The price of lessons held and the costs actually incurred by the Provider are withheld.
- The cost of the Certiport exam is not refunded once the Student has been registered in the testing centre's system.
- No refund is given for lessons the Student missed without timely notice.
10. Liability of the parties
The parties bear liability in accordance with the applicable law. The Provider is responsible for the quality and scope of the services provided.
The Provider is not liable where online services cannot be provided for reasons on the Client's side: a faulty device, no internet connection or missing software. Such a lesson is considered provided.
The Provider does not guarantee that the Student will achieve specific results, as these depend on the Student's own involvement, attendance and completion of assignments.
11. Force majeure
The parties are released from liability for non-performance where it is caused by force majeure: natural disasters, military action, epidemics, acts of public authorities, failures of communication and power networks.
The party affected by such circumstances notifies the other party without undue delay. Where offline classes become impossible, the Provider may temporarily move the classes online while keeping the programme.
12. Personal data
The personal data of the Client and the Student is processed in order to perform this agreement, in accordance with Regulation (EU) 2016/679 (GDPR) and the Privacy policy, which forms an integral part of the agreement.
No separate consent is required for data needed to perform the agreement: the agreement itself is the legal basis. Consent is requested separately and voluntarily only for marketing messages and for publishing photographs and work by the Student. Declining such consent does not affect the provision of services.
13. Intellectual property
Study programmes, teaching materials, presentations, assignments and lesson recordings are the intellectual property of the Provider and are made available to the Student solely for personal study.
Copying, distributing, publishing, passing to third parties and commercial use of teaching materials without the Provider's written permission is prohibited. Recording lessons by the Client or the Student is permitted only with the Provider's consent.
Projects created by the Student during the course belong to the Student.
14. Complaints and dispute resolution
A complaint is submitted in free form to iterraacademy@gmail.com, describing the substance of the claim. The Provider reviews the complaint and replies within 30 calendar days of receiving it.
The parties seek to settle disputes through negotiation. Failing agreement, the dispute is heard by the court at the Provider's location, subject to the consumer's right to apply to the court at their place of residence.
As a consumer, the Client may contact the National Authority for Consumer Protection (ANPC) and use the alternative dispute resolution platform (SAL). anpc.ro
The European online dispute resolution platform (ODR) is no longer available: the European Commission closed it on 20 July 2025.
The applicable law is Romanian law.
15. Duration and amendment of the agreement
The agreement is in force from the moment of acceptance until the parties have fully performed their obligations.
The Provider may amend the terms of the Offer by publishing a new version on the Site. Each version has a number and an effective date. An agreement already concluded is governed by the version in force on the date of acceptance, unless the changes improve the Client's position.
